When are you bankrupt? This is the case when the judge pronounces the bankruptcy decision on you or your company. It is also possible that you are technically bankrupt: that it already appears on paper that you are in a condition that you have stopped paying. What are you doing then? Is filing for bankruptcy with a solution? This is only the case if you have a BV, where you have not counted for anything in private and you have arranged everything with the tax authorities.
Do not file for bankruptcy if you are personally liable, ie if you are a sole proprietor, a self-employed person or a partner in a VOF. If you are privately liable for your debts and there is nothing to recover, the bankruptcy will eventually be closed due to a lack of income in the estate. The bankruptcy trustee then demonstrated that there is nothing to get, and that therefore no payment can be made. This does not release you from your liability! The claims will continue for up to 20 years. What should you do if you are privately liable for your debts and you cannot pay? Make a debt settlement.
