Amicable settlement - what does that mean to me?
If you have debts that you can no longer pay as an entrepreneur, we are happy to help you. At Zuidweg & Partners you can go through a so-called amicable debt settlement process. This is a process without the intervention of a judge. From the possibilities of your future, we will make an arrangement with your creditors for the sustainable solution of your debts. Where possible, while retaining your company. Below we inform you about everything you need to know before you start the amicable process.
Request the amicable process
In order to start your amicable journey as quickly as possible, we ask you for us application form to fill in. We will contact you within 24 hours on working days. We then schedule an intake interview.
During the intake interview you can explain your situation to us and together with you we will make a clear picture of the problems you are dealing with. Based on this analysis, we give you advice. The intake interview takes place within one week. In the event of a crisis, such as the impending eviction or closure of water or energy, the intake interview will take place earlier. We will indicate what information we need from you. You can think of your latest annual accounts, income, tax return, debt list, housing situation and so on.
Communication with your creditors
If you decide to go through your debt settlement process at Zuidweg & Partners, we will take care of communication with your creditors. At the beginning of the process, we will ask your creditors to postpone creating a breather for you. You can then relax and focus on what you are good at. At the same time, we will request from your creditors the amounts you owe and determine the legal details of your debts.
The insolvency adviser
From the start of the process you will be guided by a sympathetic and understanding advisor from Zuidweg & Partners. The consultant organizes your process together with you and is your permanent point of contact. He is supported in this by a team of legal and administrative staff.
The amicable settlement while retaining your company
If you want to continue with your business it is imperative that your business viable is. Subsequently, it is first examined whether a refinancing of your entire debt is possible. If not, we will see if you are eligible for one credit through your municipality. If no credit is available, we will examine whether it is possible to repay your debts by saving for three years (savings restructuring). A forecast of your future profit is made in advance. Your creditors will then receive a payment proposal based on this forecast.
The amicable settlement without retaining your company
Your future income is also the starting point for the settlement with your creditors here. We will work with you to calculate what you can pay to your creditors over three years. We will then talk to your creditors and offer the proposal and negotiate an agreement. As soon as you have stopped your business, it is therefore important that you get income from work as soon as possible. If this is not possible, the income from payment determines your debt settlement.
